# Terms of Service for HRM – Employee Attendance

## 1. Acceptance of Terms
By downloading, installing, or using the HRM – Employee Attendance app (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
## 2. Description of Service
HRM – Employee Attendance is a mobile application that enables employees to:
– Check in and check out with photo verification
– Track attendance and working hours
– Submit leave requests
– View attendance history and reports
## 3. Eligibility
– You must be at least 16 years old to use this App
– You must be an authorized employee of a company using this service
– You must have valid login credentials provided by your employer
## 4. User Account
### 4.1 Account Creation
– Accounts are created by your employer’s HR department
– You are responsible for maintaining the confidentiality of your credentials
– You agree not to share your account with others
### 4.2 Account Security
– Notify your HR department immediately if you suspect unauthorized access
– You are responsible for all activities under your account
– Use strong passwords and keep them secure
## 5. Acceptable Use
### 5.1 You Agree To:
– Use the App only for legitimate attendance tracking
– Provide accurate information when checking in/out
– Check in only when you are physically at your work location
– Use your own face for photo verification
### 5.2 You Agree NOT To:
– Use another person’s account or credentials
– Check in on behalf of another employee
– Falsify your location or attendance data
– Use the App for any illegal or unauthorized purpose
– Attempt to bypass security measures
– Reverse engineer or decompile the App
– Use automated systems to interact with the App
## 6. Privacy and Data Collection
### 6.1 Data We Collect
– Location data (only when checking in)
– Photos (for identity verification)
– Attendance records
– Device information
### 6.2 How We Use Data
– All data is used solely for attendance tracking
– Data is stored on your company’s server

– Contact your HR department for data requests
## 7. Company Configuration
### 7.1 Backend Server
– This App requires connection to a backend server
– Your company is responsible for server setup and maintenance
– Server configuration is managed by your IT department
### 7.2 API Endpoint
– Companies must configure their own API endpoint
– PGS-CROP Technology provides the mobile app only
– Backend infrastructure is the company’s responsibility
## 8. Location Services
### 8.1 When Location is Used
– Location is accessed ONLY when you check in/check out
– Location is NOT tracked when app is in background
– Location is NOT tracked continuously
### 8.2 Purpose
– Verify you are at an authorized work location
– Prevent time theft and buddy punching
– Ensure compliance with company attendance policy
## 9. Photo Verification
### 9.1 Photo Requirements
– You must use your own face for verification
– Photos must be clear and recognizable
– Fake or manipulated photos are prohibited
### 9.2 Photo Usage
– Photos are used for identity verification only
– Photos are stored on your company’s server
– Photos are accessible only to authorized HR personnel
## 10. Intellectual Property
### 10.1 App Ownership
– The App is owned by PGS-CROP Technology
– You receive a limited license to use the App
– You do not acquire ownership rights
### 10.2 Restrictions
– You may not copy, modify, or distribute the App
– You may not create derivative works
– All rights not expressly granted are reserved
## 11. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
– Warranties of merchantability
– Fitness for a particular purpose
– Non-infringement
– Accuracy or reliability of data
## 12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
– PGS-CROP Technology shall not be liable for any indirect, incidental, special, or consequential damages
– Our total liability shall not exceed the amount paid (if any) for the App
– We are not responsible for data loss or system failures on your company’s server
## 13. Indemnification
You agree to indemnify and hold harmless PGS-CROP Technology from any claims, damages, or expenses arising from:
– Your violation of these Terms
– Your violation of any law or regulation
– Your misuse of the App
– Your violation of any third-party rights
## 14. Company’s Responsibilities
Your employer is responsible for:
– Providing accurate API endpoint configuration
– Maintaining the backend server
– Ensuring compliance with labor laws
– Managing employee data according to privacy laws
– Providing technical support for server issues
## 15. Termination
### 15.1 By You
– You may stop using the App at any time
– Contact your HR department to deactivate your account
### 15.2 By Your Employer
– Your employer may terminate your access at any time
– Termination typically occurs upon employment termination
### 15.3 By Us
– We may suspend or terminate the service for violations of these Terms
– We may discontinue the App with reasonable notice
## 16. Updates and Modifications
### 16.1 App Updates
– We may release updates to improve functionality
– Updates may be required for continued use
– You agree to install updates as needed
### 16.2 Terms Updates
– We may modify these Terms at any time
– Continued use after changes constitutes acceptance
– Material changes will be notified in the App
## 17. Governing Law
